We operate in strict compliance with Kenya’s Data Protection Act, 2019 (DPA). Whether you are a student, a freelancer, a client, or a toolkit user, we value your trust and your right to privacy.

2. The Data We Collect & How We Store It

We operate a hybrid data model. How we handle your information depends on which part of our Platform you are using.

A. For Agency & Academy Users (Centralized Storage)

For our core platforms where you create accounts to hire or learn, we collect and store data on our secure servers to manage your profile and history.

  • Academy Users: We collect your name, email address, and course progress to manage your learning journey.

  • Agency Clients & Morans: We collect detailed professional information required for transactions, including full names, contact details, portfolio items, and payment information.

  • Storage: This data is stored in our central databases and retained according to our Data Retention policy (Section 5).

B. For AI Brand Strategy Toolkit Users (Local Storage)

The AI Toolkit is designed with a “Privacy-First” architecture that differs from our other platforms.

  • No Database for Strategy Inputs: We do not store your “Think Mode” answers, Brand Heart, or generated strategies on our servers.

  • Your Device Only: All progress, answers, and generated text are saved directly to your web browser’s Local Storage on your specific device.

  • Data Control: You have total control. If you clear your browser cache or history, your Toolkit data will be permanently deleted. We cannot recover this data because we never held a copy of it.

  • Profile Settings: Simple identifiers like your First Name and Brand Name are also stored locally on your device to personalize your reports.

C. For All Visitors

  • Browsing Data: We may collect your IP Address and basic browsing data via cookies to monitor platform performance and preferences.

3. How We Use Your Data

We process your data for specific, legitimate purposes:

  1. To Provide Services: To operate the Academy, facilitate Agency contracts, and generate Toolkit strategies.

  2. To Facilitate Transactions: To process payments and operate our escrow service via our secure payment processors.

  3. To Power AI Features:

    • Agency: To match talent with jobs using our recommendation algorithms.

    • Toolkit: To process your inputs via the Google Gemini API (see Section 4).

  4. To Communicate: To send you notifications about your account, projects, and platform updates.

  5. To Improve Services: To analyze usage trends and improve user experience.

4. Third-Party Services & AI Processing

We partner with trusted third-party providers to deliver our services.

AI Processing (Google Gemini)

To generate strategies in the Toolkit, we use the Google Gemini API (Google Cloud Vertex AI).

  • How it works: When you click “Generate,” your text inputs are sent securely to Google’s servers for processing.

  • Usage: Google processes this data solely to return the generated strategy text.

  • Data Privacy: We do not grant Google permission to use your specific brand data to train their public models.

Payment Processing

For Agency transactions, financial data is processed by secure third-party payment gateways (e.g., Paystack). Digital Moran does not store your full credit card or banking details directly.

5. Data Retention

In compliance with the DPA, we retain personal data only for as long as is reasonably necessary.

  • Account Data: Retained as long as your account is active.

  • Financial Records: Kept for the statutory period required by Kenyan law for tax and audit purposes.

  • Toolkit Data: We do not retain Toolkit data; it remains on your device until you delete it. Once data is no longer necessary, it is securely deleted or anonymized.

6. Your Rights Under the DPA

You have rights over your personal data under Kenyan law, including:

  • Right to Access: You may request a copy of the data we hold about you.

  • Right to Rectification: You may correct inaccurate data in your profile.

  • Right to Erasure: You may request that we delete your account and personal data (subject to legal retention requirements).

To exercise these rights, you can request account deletion via your profile dashboard or contact us directly.
